  • Trial law is the most stressful of legal pursuits. It takes resolve, intellect, nerve, imagination, and a lot of hard work. Allan and Summary has been bringing these virtues to the litigation table for over 45 years. As a civil trial lawyer, John Allan has represented persons and legal entities, usually as a plaintiff, in damage claims stemming from the following:

Professional negligenceLawyers negligenceLegal malpracticeAttorney malpracticeContract disputesBusiness disputesFranchise DisputesFranchise lawAccidentsPersonal injuryProduct liabilityWrongful deathMedical malpracticeReal estate mattersEminent domainCondemnation casesSecurities ViolationsInfringement Copyright and patent.

The practice has included divorces, adoption, wills, and real estate transactions.

The practice has included litigation, and real estate transactions. His career has involved him in an average of four or five jury and non jury trials a year for the past 35 or so years. This experience is of significant importance, because trying cases gives a lawyer a wealth of experience in the art and politics of life and by trial one can see how the law works out on the street, essential knowledge for a good lawyer. In 1981, he took the unpopular cause of representing clients with legitimate claims against their former lawyers. He now emphasizes the area of legal malpractice in his practice, i.e. remedies for lawyers' negligence. In 1985, he began to represent people in franchising; buying, selling, developing, and litigating franchise issues. These issues include business formation, shareholder/partnership agreements, financing, capital formation, copyrights and trademarks, sales and acquisitions, valuations, non compete agreements, copyright and patent infringement and litigation, jury and non-jury, trials, arbitrations, and mediations.

Mr. Allan's educational background is traditional. He graduated from St. Louis University Law School in 1974 and became qualified to practice before the U.S. Supreme Court, all federal courts, the supreme and appellate courts of the state of Missouri, and all courts of general jurisdiction in Missouri. He has practiced through pro hac vice orders in California, Tennessee, Illinois, and even appeared briefly in the court in Toronto, Ontario, Canada.

    Teaching experience

Aside from his own academic career as a student, Mr. Allan has lectured on trial civil practice in university and business settings at seminars. From 1976–1984 he was an associate professor of business law at the University of Missouri St. Louis and he is an occasional lecturer at the St. Louis University Center of Entrepreneurial Studies and Washington University.

  • People trust their attorneys to adhere to high ethical standards and protect their interests as clients. Unfortunately, this trust is sometimes broken.

In Missouri, legal malpractice is defined as the failure of an attorney to exercise the degree of care, skill and learning in representing a client that other attorneys would exercise in similar or identical circumstances.

At the Allan & Summary, L.C., law firm, in St. Louis, Missouri, we operate under the motto "Good lawyers are human, ... therefore there is Legal Malpractice."

Yes, to err is human. We understand that lawyers make mistakes, and that sometimes even the best lawyers make mistakes that are serious and damaging. Nevertheless, we believe that when lawyers violate the Missouri standard of care for legal malpractice, they should be held responsible for the material damages they cause to their clients.

Among the common lawyer errors for which we help our clients seek compensation include:

Failures to know or apply the lawPlanning errorsInadequate discovery or investigationFailure to file documentsMissed deadlinesFailures to obtain client consentConflict of interestFraudImproper withdrawals or misuse of clients' fundsBreach of fiduciary dutyBreach of contract

How to make good relations with elder brother's wife?

I am applying for a part time job to help boost my curretn in come(I work full time). The specification is . Strong customer service skills. ? Sales driven to achieve & exceed targets . ? Ability to address customer concerns as and when they arise.. ? Ability to work on their own. ? Excellent organisational skills. ? Good interpersonal skills. ? Strong visual merchandising skills. ? Computer Literacy. ? Fluent English. . Plese help me I never had to write a cover letter before.. Thank you..

Does anyone have any guidance or a sample letter of character reference to give to a Judge for a friend who is in a child custody battle with her parents over her daughter..

First of al,l I am against this bill, I mean law.. . I was an insurance/financial counselor at a non-profit hospital for almost 20 years.. ~~This law IS very confusing, and is meant to be. All of the provisions are meant to become effective in a staggered time line.. ~~Some aspects become effective immediately, and some will not go into effect until 2014. Some say these provisions are staggered to start, after 'key' elections. For instance, some in January 2011, then again after the presidential election in 2012, etc.. ~~The US Government, by this law, is mandating all people in the US must have Health Care coverage. Some (several state Attorney Generals have just filed suit that this is unconstitutional, that the Federal government does not have that power of each state) feel this is good, as those who have chosen not to be covered by employers, or by paying premiums themselves, must now do so.. ~~The dropping of the' pre-existing condition' exclusion, (that a person with a previously diagnosed, and/or treated condition ~ in some cases even if the condition existed and the person was unaware of it~ can no longer be used, everyone in any health condition MUST be allowed coverage must be covered immediately. A person who develops a condition cannot be dropped from a policy by the insurance company, or the employer.. ~~If you choose not to pay for health insurance you will be fined a sum ($750) per person?). If as an employer, you no longer wish to cover your employees, you will be fined. The IRS (who is opening new branches and hiring thousands, as wee speak) will oversee this, as it will be due on your income tax forms. ~~Insurance companies will have to raise their prices to help pay for those with pre-existing conditions, because of the expense of now paying for those with extremely expensive conditions they are already being treated for.. ~~Those with no health insurance, will now have it. If they cannot afford it, they will be covered. The cost will be absorbed by those who buy insurance, and whatever is in the law that will pay for it.. ~~It is expected that the health insurance industry probably has a current life expectancy of 2 years. Then they will go out of business, due to unable to pay the providers for the services of all Americans.. ~~If that happens, the government will have the Public Option or Universal Healthcare, or whatever it will be called, which will dictate all who is treated, how they will be treated for their illnesses, which medication is to be dispensed, what doctors, nurses, techs, etc. will be paid, which services will be given 'free', basically how every illness will be treated and for how long. . some say there will be so-called 'Death Panels' (which is a panel of government and health people, who will decide how much a person can be treated, and at what level, and when treatment ends in 'just making the patient comfortable' until they die'), and other rules and limits that will determine basically if a person will be treated and how, and for how long. And also who will live or die, and in what manner.. . ~I believe the government is too big. . ~I do not think the government should intrude in any private industry (auto, insurance, banks).. ~I believe health care should be decided between a patient and their doctor (and family).. ~I am afraid the states are losing the ability to govern themselves (which is in the constitution).. ~Do not like the fact, that in order to get this bill passed into law, so many bribes, side-deals and threats were made by and to elected officials.. I am afraid, that the US government is slowly moving toward one that will take away our freedoms, instead of granting and defending them.. . Please consider reading and listening to all sides Then figure out for yourself, if some of the rights granted, under the constitution, are being violated, or are in danger.

Could use a form I can download for free and print out to apply for any job. Anyone know where I can find a standard application form?. I need to download a standard application form for a piece of coursework I am doing it is not to use for a specific job..
