I am not a contracts law expert, and I'm sure there is a long case history which must be studied to fully understand it, but here is my basic understanding.. . ANY agreement between two people which commits the parties to something is legally binding. Signatures and what not don't make the agreement more binding, they just make it a lot easier to prove in a court of law that there was indeed an agreement.. . Therefore, in court a watertight document will be virtually impossible for either party to deny that they agreed to the terms of the document.. . Signed, Witnessed, Notarized document - Very Strong. Difficult to deny.. . Signed, Witnessed document - Still very strong since both parties know that a witness may testify under penalty of perjury.. . Signed document - Strong. One party can claim the signature was forged. If a lot of money is on the line, expert handwriting witnesses can be paid to determine the authenticity of the signature.. . Unsigned document - pretty weak. Easily deniable by either party. (I've never even seen that document!!!). . Verbal agreement - good luck. Not only is it difficult to prove, but even if both parties agree that an agreement was made, they may remember the terms of the agreement differently. If the document wasn't worth writing down, it probably isn't worth going to court over anyway.
