• I received my Bachelor of Arts Degree in political science in 1973 from the University of California at Los Angeles and attended the Loyola University School of Law in Los Angeles. I graduated magna cum laude in 1976. While at Loyola University, I was on the Dean's List each year and the recipient of the Bancroft Whitney Award and the American Jurisprudence Awards in Conflicts and Remedies.

  I spent over 24 years at the Los Angeles based AV rated law firm of Spray, Gould & Bowers, APC, including two and one-half years as the firms President. I left Spray, Gould & Bowers in mid-October 1999 and to open my own firm in Westlake Village. While at Spray, Gould & Bowers, APC, I practiced primarily in the coverage, appellate, personal injury and bad faith areas.

  Since leaving Spray's, I have been engaged in a private insurance defense practices in Los Angels and Ventura Counties and along the California Central Coast. These practices dealt with automobile litigation and construction defect litigation involving single-family homes and multi-unit projects, primarily for subcontractors, as well as coverage litigation involving commercial general liability coverage's.

  I am admitted to the State Bar of California, the Ninth Circuit Court of Appeals, and the United States District Court, Central, Eastern and Southern Districts of California. Taiwan is not currently an independent sovereign nation.. . At the present time, Taiwan has "no government.". . Most people will think that this statement is ridiculous, because they will say that the government in Taiwan is the Republic of China.. . However, this is the problem. The world community does not recognize the Republic of China as the legitimate government of Taiwan. Thus, under international law, Taiwan has no government, is not a sovereign independent nation, and cannot enter the United Nations.. . So, what government should Taiwan form now? Of course it should form a territorial "civil government." This is explained further as follows --. . In order to understand the need to form a "civil government" for Taiwan here in the 21st century, one must understand that in the post-Napoleonic era, according to international law, . (a) the completion of the surrender ceremonies in Taiwan on Oct. 25, 1945 can only be interpreted as the beginning of the military occupation of "Formosa and the Pescadores,". (b) under the laws of war, "military occupation does not transfer sovereignty.". . Hence, as of Oct. 25, 1945, the position of the ROC (of Chiang Kai-shek) is as a subordinate occupying power under the United States. The United States is the "principal occupying power.". . In late 1949, remnants of the ROC government moved their central government to Taiwan, which was occupied territory, and not Chinese territory. Hence, by mid-December 1949, the ROC has become a government in exile. . . In the April 28, 1952, San Francisco Peace Treaty (SFPT), Japan renounced all rights over Taiwan, but no "receiving country" was specified. Under international law, Taiwan escheats to the "conqueror" and "principal occupying power" -- the United States of America. The Republic of China is not the legal government of Taiwan. . . The Sino-Japanese Peace Treaty recognized the arrangements of the SFPT in regard to the disposition of Taiwan. Article 26 of the SFPT serves to authorize the drafting of a peace treaty between the ROC and Japan.
