If the Status Quo Isn't Working

No one intends to go bankrupt. In fact, most people go to great lengths to avoid filing bankruptcy and wait far too long than they should. Instead, they struggle to keep their heads above water in the face of an overwhelming amount of debt. Skipping payments, paying less than the amount due each month, borrowing, cashing out retirement or college savings plans:These are just a few of the most common bankruptcy-avoidance strategies. In the meantime, your credit rating has bottomed out.

Why wait? After bankruptcy, the defaults and late payments are removed from the credit reports and listed under your bankruptcy. Many people find they're able to get mortgages and credit soon after bankruptcy. Best of all, they're able to handle debt better than ever, resulting in improved credit scores.

Get a Fresh Start Through Bankruptcy

Both Chapter 7 bankruptcy and Chapter 13 bankruptcy give you a fresh start. Some of the benefits that come with filing a Chapter 7 or Chapter 13 bankruptcy include:

Creditors stop harassing you. By law, creditors and bill collectors must stop calling, writing, and sending bills or dunning letters. If they don't, they can be sued for monetary damages. If your paycheck is being garnished, this will stop.Eligible debt is discharged or reorganized, depending on which type of bankruptcy you qualify for.Foreclosure proceedings will be halted, at least temporarily.

Anyone know a free program that creates an operating agreement for an LLC?

Other than Reagan appointee greenspan keeping interest rates low, how did the govt. cause the housing bubble?

It is illegal to do a background check on a prospective employee. Things like, a credit check and drug screen can only be asked of an employee that has been offered a job and only as a term of employment. IE you have to pass minimum standards to continue on in the hiring process. If you are in a position that you will need to be bonded (some place you handle money or high value equiptment) then they will need to do a full background check to be able to prove to their insurance that you are a bondable employee. If you choose to accept the offer the paper work authorizing this will be included with your hire packet and if a drug screen is needed you will have maybe 48 hours tops to get it done. If a company were to do this before they offered you employment it would then appear to be a discriminatory practice. After the fact though it is a precautionary practice. The have gone through the hiring interviews and selected the best person for the job. Now they can make sure you fit thier minimum ethical standards. If you dont then they will go through the process all over again with the next potential employee. If you read the releases carefully the only thing an employer can refuse to higher you for is failing a drug screen. Basically they cant tell you that your credit isnt good enough for them or that you can not be bonded by thier insurance they can just say that you have been refused the job based on information given to them by "X company" and they have to provide you with the info for the company that provided them with the negative info. If this does happen call this company and find out what they are telling your prospective employers. It may be miss information that needs to be corrected by you. Good Luck.

My grandmother in-law was recently hospitalized and she had me as her durable power of attorney (which I know ends at her death) and she had me make out her will and our witnesses signed it. A good friend of hers is a notary and spoke with her over the phone and verified her wishes. So I got the notary to notarize the will outside of the hospital when she had the time. And my sweet "granny" was always in her right mind medically. Well, my grandmother in-law passed away three weeks later at home. Our notary then got nervous and said although she knew the wishes of my gil she was uncomfortable about the will since a relative wants to contest the it. They are only contesting it so they can sell the house she left to me for taking care of her, the relatives were never left out and they get significantly more. Can the notary get in trouble for this? If called into court for the contesting what happens? Thank you so much..

I am planning to buy a home in San Diego, but the records on the county assessor's web page does not match the information provided by my Real Estate Agent. I cannot quite explain the discrepancy. I discussed this with my Real Estate Agent and he/she cannot quite explain it as well.. . 1) Under what situations can the listed home belong to the Real Estate company selling the home [ The Real Estate company is a 6799 Investment company ].?. The Real Estate Company claims that the sellers are from out of the country and all paper work takes a long time to be acknowledged in terms of signature or any other agreement.. . 2) The taxes due on the assessor's page does not match the sale price. It is way less than what the home sold for in 2005. The home sold for around $ 600 k in 2005, but the tax rate is only $ 3,500 per year. It should be around $ 6,500.
