I have tenants who's lease is up as of the 31st of next month. They're my friend's sister and his wife. They were really good tenants for a long time, but something happened & now they're going through a divorce. She'll be out in the next few days, but he was refusing to leave the house. Since she's the one with a job, we're obviously not comfortable (as far as being able to get rent) have someone with no income living there. We gave him a non renewal of lease letter the other day stating he had 60 days to vacate, as per a verbal agreement they had with my fiance. He said that he'd be out and have the house cleaned out by that date (April 17th) and he'd live out his security & pay the prorated amount of rent for April. We were ecstatic with that, we thought it was going to go much worse. The other night I got a phone call from my friend telling me she was at her mother's house & he was there. That's where he intends on moving to. Their mother asked him what he was going to do with all the stuff his wife doesn't take with her because she didn't have room for it all in her house. He told her that he plans on just leaving it there because we can't ever throw it out and that way we can't re rent it. If we're going to be "jerks" (substituting for a few much worse words) to him, he was going to give it right back to us. That if we did throw it out he was going to charge us with grand theft. I don't think everything in there would add up to enough for grand theft, but that's beside the point. We've never run into this problem before, but we do know we don't have to keep it forever. I searched on line and called a few real estate attorneys and got a bunch of different answers as to how long we're actually required to keep it until we can legally dispose of it. I heard and read 2 weeks, 30 days, 45 days, 60 days, 90 days. I'm fairly certain its not 2 weeks or 90 days and I'm kind of saddened by the fact I got different answers from real estate attorneys, but does anyone know for sure? I know I have to keep it for a certain amount of time, but I don't want to end up in any kind of court because I removed it 1 minute too soon. I think landlord laws are different for New York City, this isn't New York City, its upstate in Ulster County. Thank you in advance for any info!.
now, i have to ask you: why in the world don't you have a buyer's broker? why are you going on this all on your own? go to a Realtor (r). it doesn't matter if the seller is a "FSBO," meaning "for sale by owner." because the two of you, without agency representation, may be sorry that nobody was around to watch what happened to each one of you, and when. you may write yourself into a disaster. if you hire a buyer's broker, it will not cost you. they will call the seller and get an agreement to get paid by him when the deal closes. then, being the nice person i am sure you are, when it comes time to sell, you will call your buyer's broker first, since we are able to act as buyer's, seller's, as well as dual, agents. AGENCY is the key word here: get someone to represent YOUR interests over those of the seller!
