A durable power of attorney will allow you to sell property for your father, or transfer title to automobiles and other personal property while he is still alive. When your father dies all the power you had as his attorney-in-fact ends immediately. And at that point you will have to file a petition in probate court to have his will allowed and have you appointed as the executor of his will.. . Your father should consult a competent attorney to get a durable power of attorney prepared so that you can take care of those things that he wants taken care of. Beware that you might have to have special forms to transfer automobile registration forms. Check with your Registry of Motor Vehicles with respect to their procedures when POAs are involved. If complicated, get your father to sign the required forms himself while he still can.. . Remember that if your father owns any real or personal property in his name alone at his death, then you will have to probate his Will and be appointed the Executor/Executrix thereof in order to sell that property. But you get a step up in cost basis for income tax purposes if that property is included in the computation of your father's federal and state estate tax (even if no tax is due, which is almost always the case).
