Where on earth do you start. . As a starting point historically exemption/ exclusion clauses go back pre our 'modern day' concerns about fair trading, equality of bargaining power, unfair contract terms, sale of goods acts and regulations, consumer protection and all those similar issues. When people traded with each other and made contracts they were assumed to be on level terms with each other and if people made contracts with 'get out',for that is what we are talking about, clauses that was perfectly ok in a laissez-faire attitude. Laissez-faire, an attitude or policy of not interfering and letting events take their own course. . Off course people were not on equal terms and gradually the law stepped in, now I suggest its a question of balancing laissez-faire and a legal nanny state interventionist approach.. If someone wants to rely upon exclusion clauses it will need to be quite clearly incorporated as a term of and into the contract and it will have to deal very specifically with the incident which the exclusion clause claims to exclude. Then the exclusion clause must not fall foul of legislation which prohibits its operation. . You'll need to consider issues such as previous, consistent and normal business terms of contracting between the parties. The narrowness of construction applied by the courts to exclusion clauses. Exclusion clauses not being able to defeat a fundemental breach of contract. Additional remedies available to a party who suffers and wishes to fight the exclusion clause, such as claims in tort and negligence. Then go on to look at the various consumer type legislation I've hinted at already, who and to what types of dealings does it apply to and so on. . Phew, that should keep you busy for a while, and I leave you and others reading it with one of my favourite, unfair, enenforceable exclusion clauses. You often see things at the car wash, and similar business concerns, stating the management will not be responsible for death or injury to the user no matter how caused. Rubbish I say, no contractural term can exclude or limit a negligent liability for death or injury caused to any other person and any exclusion limitation claimed to exclude negligence to property depends on passing a test of reasonableness.

I'm a teenager who wants to make an awareness documentary about suicide, depression and self harming. I want to target the common stereotypes people associate with Suicide, depression and self-harm. I don't want a plain text-based slideshow documentary - I want to make an informative documentary-film with re-creations of real events. (not huge events. just actors and locations - though locations probably won't be a problem). I understand that as I'm young and have a very limited budget, that this won't happen for some years time - but I was wondering how someone could go about making a documentary? would you have to ask for help from a label or make a deal with a TV company etc? I genuinely don't know where to start.. Please help?.
