Well, first of all you are talking about two seperate people, and two seperate estates, so you'd have to do it twice.. even if they died at the same time, it would be two seperate estates in probate court.. . The executor in most states files the initial request to set up the estate and be named officially as executor in probate court, they then do all the administrative tasks as far as collecting up the asset paperwork, selling the house on behalf of the estate, the cars, whatever, or maintaining any of those if they're being willed to a beneficiary. You're basically the secretary/babysitter of the assets, and you sign all the court documents. You also have to represent the estate for any claims that come in against it from creditors, or hire an attorney to do that for the estate.. . You're also caught in the middle of any disputes the heirs have over the money.. :) Sometimes that's tough if it's a nasty crowd. You don't earn money for doing it, but you can collect the fee as mandated by the state for your time, it's usually not much.. . Most states require the executor to be bonded in order to serve in that capacity, so if you've had a bankruptcy or a felony conviction you can't do it (not saying you have, just telling you.. :)

Although life is awesome there are no guarentees and no safety nets and I feel it is good to be prepared in the case of a loss.. . How does one go about making a last will and testament and a living will? Do you need an attorney or a notary republic to approve this? In addition if the married couple does not have chldren nor plans to ever have children how should the estate be divided up?. Who makes the best excecutor of the estate you have? . Is this hard to do?.
