and I am assuming your employer was not a party to this contract.. . Given that you signed the contract with the agency, creates a small issue, but it can be resolved as follows:. . (1) Assuming the agency signs documents and conducts business on behalf of the employers, it may be shown that the agency is the legal 'agent' for the employer. Hence actions of the agent in the normal course of business will be the actions of the employer. Thus, to simplify, your employer will be bound by the contract you signed with the agency, and is bound to keep you employed for 11 weeks.. . (2). The Agency dealt with you. It made a representation to you (in writing) that the employment was for 11 weeks. You believed this. Had you known it was only for four weeks you would not have agreed to this contract. Based on the 11 week representation, you therefore entered into the contract, which now has worked to your detriment. This is a legal misrepresentation, against the agency, and you can sue the agency directly for misrepresentation and recover the difference in the pay you would have received, as well as other legally allowable expenses.. . (3) Also the Agency dealt with you and in its contract stated the period of employment to be 11 weeks. There are now attempting to back out from the contract and this term, and this is a breach of their contract with you. Assuming that there is no limiting clauses in the contract, you would be able to recover for money/compensation reasonably contemplated at the time of signing the contract, which includes the amount of money (difference) for the 11 weeks of work.. . Winning a legal case, requires proof and evidence. I have very little facts here, but generally I would assume that the agency would deny being an actual 'agent' of the employer and would make the first option be a little difficult to prove. You would need to look at the conduct of the agency and other factors to determine how connected they are to the employer, so as to establish a legal 'agency'.. . On the other hand, the second option may be more viable as it places the agency in the direct line of legal fire. Practically, you would get your equivalent money's worth. You already have the contract in writing with the 11 week representation. Most of your proof is thus essentially there
