My husband and I are going to buy a Snow Shack (snow cones). We don't want to just hand over money and get a receipt and be gone. We want a contract stating what stays in the building and what goes. So this person can't come back and say oh, that didn't go with it. Or that doesn't stay. I really just need some ideas and samples of business agreements.. We are not buying the building..The landlord is letting us take over with a new lease. We are buying the contents of the building and we are changing the name of the place and starting new. What debt she had before is hers. I just need something stating that.

Yes it's legal. It may not be advisable, however. As with many things in life, just because you can doesn't necessarily mean you should in all cases.. . There are several things you need to consider. First of all, they're your neighbors. You have to live next to them, potentially for a very long period of time. Depending on the type of people they are, you may or may not want to consider whether such a letter will cause problems with their ability to live peacefully next door to you. Basically, only you are in a position to really know whether getting the $700 back is worth the sort of reaction they will have. If your neighbors are the sort who would retaliate or otherwise cause trouble, then as much as it isn't "fair", the best thing to do might be to let it slide.. . If you're on decent terms with them, you might consider just asking them in person to reimburse you for the damage caused by their dog. Of course, only you know if they're the sort of people who would be responsible enough to pay for damages caused by their animal.. . If you do go with the letter, include receipts or some other independent listing of the damage amounts so they understand that you're not just coming up with a number off the top of your head. You'll also want proof that it was their animal which caused the damage. If you can't prove that it was their dog, then you're kind of out of luck.. . Writing a letter won't have one iota of effect on their ability to counter-sue. First of all, they'd need something to counter-sue for, and, based on what you have said, they don't have any basis for a counter-suit. Unless there's something you haven't told us, even if they tried to say that you'd somehow lured their dog into the chicken coop their claim would likely not stand. Regardless, going immediately to court doesn't stop them from filing a counter-suit (however frivolous such a suit might be). When you go to court, the defendant has time to prepare a response and to assert any counter-claims he or she might have. This _cannot_ be prevented by going straight to court.. . What I would do, if talking in person was out of the question, is write a letter politely outlining the damage and the cost of repair along with your proof that the damage was caused by their dog. I wouldn't mention court yet. Make it look like a friendly "hey, here's what it cost to fix things" sort of letter, not a "pay me or I'm suing" sort of letter. You'll want to make extra sure that it's polite because if you do end up in court, you want to look like you're the reasonable party and if your letter is angry and demanding in tone, it won't help you. Be as nice as possible throughout the process
