The brain damaged baby also only gets $250k, but for his lifetime of care, he will need much more than that. By age 3 he will be through that, and then he will be placed on Medicaid, which is paid for by the taxpayer. Of course, if you have no Medicaid, his healthcare will be paid for by the taxpayer. This baby has no ability to ever hold a job, but he still must be cared for. And the mommy who died? Her family didn't get to sue for her wrongful death at all. Dead equals noneconomic damages, and you don't get to sue for that.
