Financial Planning, How to keep my check in "check"?

When my son's father and I split up he took me to court to have my son's last name changed to his last name... The judge decided on a hyphenated last name. I never wanted the name change to begin with but I was given no choice... My son already knew his last name so we were not changing it completely... It's been over a year now since the final judgment of the name change and I just found out (because I applied for a new birth certificate) that his name change was not filed with the state by my ex. Obviously I was not going to do it because he was the one so persistant on getting it changed and I thought he was taking care of it... now my son has been going to school with this last name that was never actually filed and his health insurance and my life insurance has this new last name.... now my ex says he doesnt care about the name change anymore because he didnt get the exact name he wanted (which was his only, no hyphen) so he is not planning on filing the paperwork with the. state and that I should do it... well I would rather not if his name hasnt been legally changed... there was a final judgment but it wasnt filed... so is his name legally changed or can I just change it back and forget about it..
