I opened a bank account with Abbey around 6 months ago. A current account which has no charges. I havent put any money into the account and I havent spent any. But somehow my balance is -?278 due to 'charges'.. . I have phoned Abbey serveral times and been in to a branch and they say they will look into it. But still nothing!. . I need to write a letter of complaint to them, so do you know of a template or perhaps someone could draft me one?. . I have looked on money saving expert etc but theres no ideal letters.. . A joint account is most often "joint account with right of survivorship". Under US tax law, the money is deemed owned by the person who put it in the account, and becomes a gift only if the other person removes it. (In the USA and UK gifts are not taxable between spouses in most cases (exceptions relating to aliens in the US and non-domiciled persons in the UK).) But in theory an account could be held as tenants in common (each owning half) and in a handful of US states they can be held between spouses only as "tenants by the entireties" which has the advanntage of making them unavailable to creditors of just one spouse.. . One or two persons can have an account as trustees for others. Then the rights of these beneficiaries depends on a trust deed, which you have not described.. . Without knowing what your trust account details are, I would say the following: an account is (probably) either a joint account or it is a trust account. If it is an account commonly (but erroneously) called a "trust account" between spouses, then it is a Payable on Death account that does not go through probate but goes to the wife on death. But in the UK clearance from Inland Revenue would probably be required. States don't usually require tax clearance, especially between spouses.. . But if the account holder holds the account as trustee under a trust deed, we can't know who is a benerficiary or how many there are or what rights they have without reading the trust deed.
