In the former capacity, he tried numerous homicide trials as well as other complex criminal matters specially assigned by the Essex County Prosecutor. You will of course need to check what the local rules/laws are about when you get the license. Some places are right after the witnesses sign it, and other places require tyou to send it back to the State/Local Government so that they can copy it and file it, and then they return it to you. . As far as the places to contact, open your wallet/purse and look at everything that is in there. If you name is on it, you will want to call them and change it. Look at all of your mail/bills, and call them as well. He should do the same and add your name to any accounts that your name doesn't currently appear on. Only 2 cases have ever gone to court and had a proper hearing, and the judgements were released last tuesday.. . The cases went to court accidentally, Lloyds settled with everyone else on the same day, but overlooked the paperwork for 2 cases, so didn't settle, and the cases ended up going to a hearing. As Lloyds settled with everyone else on the day, it shows that even they didn't think they would win!. . The first case was dismissed, because the claimant sent no evidence about his claim, why the charges were unfair, the amount he was claiming for etc, so this is understandable and was doomed to failure.. . The second case was the one that was won by Lloyds. The judge went against expert opinion and ruled in favour of the bank. The judge looked at the "wrong" evidence to make the ruling, ie the current terms and conditions of the account he found on the internet, rather than the T and C's at the time of the charges. The banks have cunningly changed the wording now, to get round the law, and even though the wording wasn't the same when the charges came about, the judge still ruled in the banks favour.. . Thankfully, it does not set a precedent and won't affect anyone elses case. It is still too risky for the banks to let cases go to court, as losing would be a lot more damaging for them than it would be to the public. So they are still settling out of court.. . I`ve successfully claimed back over ?700 from HSBC myself, and i`m currently persuing a second claim. I run a site to help people claim their charges back themselves, and as such have had experience of a number of other banks and building societies.. . Use the steps below, and the template letters on my site and you should have a good chance of getting a full refund of your charges.. . The full process and timescales for claiming back your charges is:. . 1) Write to the bank and ask them for a copy of your charges for the last 6 years, or alternatively a set of statements for the same period. You do this by making a "Subject Access Request" under the Data Protection Act, enclosing a cheque for ?10 made out to the bank. This by passes the banks normal charges for statements which is normal a large amount for 6 years worth. The bank have 40 days to send you the data.. . 2) Write to the bank asking them to refund your charges, giving them 14 days to reply, attaching a "Schedule of Charges" (a list of the charges you are claiming for).. . 3) Send the bank a "Letter before Action" giving the bank one last chance to refund your charges before you take court action. They have 14 days to reply.. . 4) File a claim online using the Money Claim Online web site run by the UK Court Service. The claim is served on the bank 5 days after its submitted. The bank has 14 days to acknowledge the claim. If they don't you can request a "Judgement by Default" and you win the case, and get your charges, statutory interest at 8%, and your court fees.
