I have been living with and caring for my elderly mother in her home for the past 7 years. Recently, and quite unexpectedly my mom passed away at 81 years of age. Unfortunately before she passed we were not able to complete the living trust that she wanted to replace the living trust that she had.. In the new trust she wanted to make me the ececutrix and she also wanted to leave to me her home, it's contents and her car. She had drafted a letter to the family indicating what her intentions were and why and I had begun the process of making a living trust but it was never notarized. When mom fell ill we signed it with 2 witnesses present who also signed it but we never got the chance to notarize. My mom leaves behind 2 living children and 6 grandchildren. Will I be able to get the house and finalize her wishes or will the old trust come to light and prevail. Mom could not recall making the first trust or where it might be. She also has a safe deposit box. I am assuming the trust is there. So I guess another question is how do I get into her safe deposit box to see if it is there?.
