Let me give you a little background~. My son passed away a couple years ago and I am a co representative of the estate along with my ex wife. My ex wife hired an attorney (which is her probate attorney) to pursue wrongful death case. I was not comfortable with "her" attorney acting on my best interest because of bad water between us. So my probate attorney offered to stay on the case and and review all documents prepared by the other attorney to assure that my best interest was in mind. My probate attorney worked out an agreement with the other attorney so that he gets paid a percentage of the wrongful death attorney's recovery. We were very confident in the work provided by our probate attorney but now feel that since "her" attorney is essentially paying him he is more on their side than ours. During our first recovery and distrubtion my ex wife and I agreed to put an amount equivelent to our personal representative fee in a college account for our daughter. The estate paid directly to the college fund. By doing this we did not have to pay taxes on the PR Fee becuase we didn't actuall claim it we set an amount equivelent to to the college fund.. . My question is we have another large settlement coming, my ex wife and I are each entitled to claim 3% for a personal repesentative fee. I want to put the fee in the college account just as we did before. But, my probate attorney is claiming that we should not claim the pr fee because it will be taxed as income. I have tried explaining that I want to do exactly as before and she is adament that we should not take the fee.. . Lets just say that the recovery was $1M and the other attorneys fee is 40% if I take the PR fee does that come off of the $1M or the $600K left after the attorney fees? My only assumtion is that they do not want us to take the PR Fee becuase it will make them personally recover less? Our probate attorney told me that the PR Fee is paid on what is left after the attorney's fees...is that correct?. . We are in Florida. I am typing this for my husband.

Hello. . Im from Bolivia and i met a guy from australia 5 months ago, he came to live with me and my family during 2 months, during that time he didnt pay a penny for anything, was giving everything to him (food, electricity, a car, everything!). After those 2 months he leave, and i found out i was pregnant, he promise me marriage, that we will sort it out either me going to australia or he moving in my country. With the time was more and more difficult find him to talk about the situation and now im 4 months pregnant and desperate about what to do. Im planning to to australia, and give birth there, because everything is a mess in my country, I do think will be the best for the baby. My questions are.. If i can give birth there without having troubles because im planning to go with a tourist visa. And if i get some support from any institution in legal advice to get to my baby the last name of the father, and get with it Child support, because i will be single mother. please help. Well i have no problem proving he is the father, and im planning go to Australia.. Is not in my mind adoption, is my baby and i love him/her. has become my world, and i want the best for him/her. but i need to know if being there i get some help.. Well im sorry to say that he doesent love me or the baby obviously. Yesterday i think was our last conversation online. ( finally after search him for weeks and weeks)and he try to convince me to stay in my country, so he doesent have any responsability off course. No intention to get married, just to get the rights for the baby and make him be responsable for what he has to.. . I appreciate a lot you help. I have found in a rising market that it is often more cost effective to just go ahead and buy the property in the location that you want, and remodel the property rather than wait for exactly the property that you want.
