    Hello,. . I am studying a case in which an individual was sold a product of very poor quality that did not work as well as it was advertised/that the dealer told him it would work. However, the dealer is refusing to give him his money back becuase he signed a purchase agreement that said:. "No warranty or condition, express or implied, shall apply to this agreement with respect of fitness for the use intended or as to performance, except those specifically stated herein." The only other thing it said in the contract was that it was a new model of xxxx product.. To me, this seems to say there's no warranty for the performance of the product and therefore this individual has no rights at all. Would you say this is correct? Seems terribly unfair, but I don't see any way that you can (legally) fight it.. It wasn't an as is item. It was a new item (said in the contract). The dealer assured him it would work three times faster than the machine he currently used and the advertising also said this. However, the new item didn't work three times faster - it worked even slower than his old machine. It appears as though he has waived any rights to having a decent product by signing this agreement.. However, the question asks what are his rights and that is why I am asking. It seems that (although tricky of the company that sold the machine to do this) Hatfield does not have any rights. I am wondering if any one can think of a legal argument that would give him rights in this situation.. And don't try to make me sound like an idiot - I didn't say I thought there was a warranty.
