The forms will be dependent on what state you live in & what deeds are used there. In Washington, either a Promissory Note and Deed of Trust OR a Real Estate Contract would be used. Both have different foreclosure methods and timelines. REC has a right of redemption, DOT does not. Deed of Trust is recorded at closing. REC is not.. . Deed of Trust is the preferred Deed of choice for this scenario in Washington State.
