    In the state of California, if you two aren't married then the only way the father can have your child take his name is IF he signs a Declaration of Paternity at the hospital when the baby is born. The DoP will be given by hospital staff in charge of birth records and they'll know to give it if he shows up anytime BEFORE you are discharged. Otherwise, your the baby will automatically have your last name on the birth certificate. If the DoP is not signed, then he will have to go to court and petition the court to have the child take his name. At that time, he'll also have to take a paternity test proving that he is indeed the child's father.. . As far as costs go, he'll find all of that out at the family court if necessary. And for hyphenated names, again, he'll have to sign the DoP before his name is included on the child's birth certificate and if it is hyphenated, then it is considered one last name, not two.. . I live in California. I believe the DoP was introduced in the mid-late 90's because when my son was born in 94, I was able to put his father's last name on the birth certificate with no problem even though we weren't married and he wasn't present at my baby's birth. But by 98 when my first daughter was born, her dad had to sign the DoP since we weren't married at the time.
