    The Transit Authority must pay workers ' compensation to a bus driver who was injured help-ing a teen being assaulted on a subway platform, even though .the driver was on a paid break at the time, a judge has ruled.

    The TA had ar-gued that Rodney Plummer 's shoulder injuries, suffered when he fended off two young men at-tacking a 17-year-old in February 2000, were not work-related ? and the agency hasn 't paid him a dime for more than a year.

    But Administra-tive Law Judge Bar-ry Greenberg of the state Workers ' Com-pensation Board ruled Tuesday that Plummer, 49, was on duty.

    He was assaulted in uniform ? making him appear to the teen to be a police officer ? dur-ing a paid break in which he was getting his lunch and traveling to a bus depot, the judge noted.

    "Hopefully, this will send a message that, if you do the right thing, good will come to you," Plummer said. "It might take some time, but it will come."

    His lawyer, Dan Morrin, add-ed: "It was an outrage that the TA contested this case in light of the fact that he was coming to someone 's aid."

    The judge directed the TA to pay Plummer about $18,000 and $300 a week for as long as he 's disabled. He also can apply to the TA for additional pay that would pro-vide him with hun-dreds of dollars more a week, Morrin said. Two weeks after the assault, Plummer returned to work, but four months later he said he felt his shoul-der pop while driving a bus. The new injury required two opera-tions and months of physical therapy.

    Asked whether the TA would appeal, a spokesman said: "We are involved in discus-sions that we hope will finalize the matter to everyone 's satisfac-tion."

    When the Daily News first re-ported on Plummer's plight in March 2000, the TA was blasted by Mayor Giuliani, who gave him $1,000 from the Crime Stop-pers program. The TA also gave him a $1,500 reward.
