if you leave your estate to a trust, discretionary or otherwise, and leave your solicitor as executor, how likely is it that he will follow your wishes? After all, if its "discretionary" cant s/he just decide what s/he wants to do with it since s/he is Trustee? Could he actually just decide to dish out masses to himself since there is no one else to "check up" on him as Trustee? thanks. . Are they more likely to follow your wishes if it is NOT a "discretionary" trust? rather some other sort of trust? if so, what trust would be better to set up? thanks. i dont want to leave it to someone underage i want to leave it to SENIORS and charities. if seniors die etc it goes to someone else, it also allows him to be more flexible with percentage of estate if their circumstances change..

An irrevocable living trust was made about 15 years ago. The descendant is close to the final hours. In her past 3 years of life she made a new will which states that everything she owns be given to her son who was only stated to receive a small portion in the trust (10%). The beneficiary (step-child) is not included in the new will. The sons name was put on all accounts as joint tenant as well as all of her property (houses, cars, etc.) However, the living trust still exists.
