The child's father may have priority over getting custody, whatever you do. You should have a "springing" "durable" power of attorney at least for the short run. "Springing" means it takes effect when you become incompetent for some reason. "Durable" means it lasts until you become competent or die. It terminates on your death. Generally not, but there are exceptions. There is a doctrine called the "parol evidence rule" holding that an integrated written contract may not be varied orally. However, there are exceptions. First, if the contract is not "integrated," evidence of oral modifications or related agreements may be admitted. An "integrated" contract is one that purports to be a complete expression of the parties' agreement on the subject matter.
