Legally, the hospital would not have to recognize the out-of-state marriage license which Texas' law will not recongize.. . Practically, it's up to the individuals on the ground to decide who does and does not have the power to make those sorts of decisions. If you walked in to a hospital with your injured, comatose partner and said, "We're married out-of-state and I can make medical decisions for him until he's awake," chances are probably pretty good that they'll listen to you.. . But if you want to make absolutely sure, because your state's laws discriminate against you, then yes, you and your partner should give one another powers of attorney. In fact, it's not a bad idea for heterosexual couples, whether married or not, to do this -- the Terry Schiavo case is a good example of that.. . It's a shame that anyone would have to do that and people can't deal with one another in good faith, but that's the reality of living with discrimination.

I think it has to do with right brain vs. left brain writing. I experience the same difficulties, only in reverse. I can sit down and write a research paper or magazine article or procedure for a manual without a second thought. My fiction, though, is at times like getting blood out of a stone. I find that the creative writing part demands to be done on its own time, when only IT is ready.. . Trouble is, you must learn to do the left brain type of writing if you're going to get through school. Tell your creative muse to take a back seat and apply all that energy to what's important in your life right now - your education!

But here in the US, being "next of kin" carries weight only if an individual has not signed a written document identifying who he wants to make decisions for him if he is unable to make decisions for himself. In end-stage liver disease, people often get confused and demonstrate an inability to think clearly and the durable power of attorney goes into effect.. . It sounds as if you are being kept from seeing him. If such a document does not exist, or if you are the person identified in such a document, then there is something you can do. If it exists, you need that document. Here, it is called an Advanced Directive and/or Assignment of Durable Power of Attorney for Health Care. Call the hospice that is taking care of him and ask to speak to the social worker on his team. Tell her your story. She is probably legally bound to respect any such documents.

I have legal letter sized templates, and 4 by 6 inch templates, etc. etc. and now I need a 2 by 2 inch template, but I can't find one. If all else fails I will go out and buy a 2 by 2 inch envelope, unfold it, and make my own, but I'm really not looking forward to that.
